Terms of Service — edu-optics.com
Effective date: July 5, 2026
These Terms of Service (“Terms”) form a binding agreement between you (“Buyer”, “you”) and edu-optics.com (“we”, “us”) governing your access to and purchase from the Site. By placing an order you confirm that you have read, understood, and accepted these Terms.
1. Who we are
edu-optics.com is operated by Dawid Kazanowski, a sole proprietor based in Poland (see Legal Notice). Contact: eduoptyka@proton.me.
2. Definitions
Site: edu-optics.com. Product: a digital file or package of digital files (PDFs) offered for sale on the Site. Order: your purchase request submitted through the Site. License: the usage rights granted in Section 6.
3. Who can buy
Our Products are intended primarily for optical retail businesses (opticians, eyewear stores, optical dispensaries). By placing an order you represent that you are at least 18 years old and legally capable of entering into a binding contract.
4. Products and descriptions
Product descriptions on the Site are provided in good faith and are as accurate as we can reasonably make them. Because our Products are educational materials — not medical advice, prescriptions, or professional consultations — you are responsible for how you use them in your business.
5. Orders and payment
- All prices on the Site are in U.S. dollars and are exclusive of any taxes that may apply based on your location.
- You submit an Order by completing checkout and paying via one of our accepted payment methods. The contract of sale is formed when we send you an order confirmation email.
- We may refuse or cancel an Order if we detect fraud, a payment problem, or a violation of these Terms; in that case we refund the amount charged.
6. License grant
Upon successful payment, we grant you a non-exclusive, non-transferable, worldwide, perpetual license to use the purchased Products for the internal purposes of one (1) optical retail location, subject to the restrictions in Section 7.
The license includes the right to:
- Print the PDFs, in any quantity, for use in your own shop (walls, waiting area, exam room).
- Hand printed copies to your customers as informational leaflets.
- Display the printed materials on your shop’s social media, in your own newsletter, and on your shop’s website, provided that the material is not modified.
7. Restrictions
You may NOT:
- Resell, redistribute, sublicense, or transfer the files or a link to the files to any third party.
- Post the raw files (PDF, edited or unedited) on a public website, marketplace, or file-sharing platform.
- Use the files for a chain of shops (more than one physical location) without a separately purchased multi-location or chain license.
- Remove, obscure, or alter branding, watermarks, or attribution embedded in the files (adding your own shop logo is expressly permitted).
- Use the Products to imply endorsement by, affiliation with, or accreditation from any medical board or regulator.

9. Refunds
All sales are final once the download is accessed, subject to the exceptions described in our Refund Policy. Please read the Refund Policy before placing an Order.
10. Intellectual property
All Products, including PDF files, illustrations, text, layout, and design, are the intellectual property of the seller and are protected by copyright and other applicable laws. Except for the license granted in Section 6, no rights are transferred to you.
11. Warranty disclaimer
The Products are provided “as is” and “as available”, without any warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law. We do not warrant that the Products will meet your specific business needs or that the Site will be error-free or uninterrupted.
12. Limitation of liability
To the maximum extent permitted by applicable law, in no event will we be liable to you for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of the Site or the Products, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or related to these Terms or your purchase will not exceed the amount you actually paid for the Product giving rise to the claim.
Nothing in this Section limits any liability that cannot be limited under applicable mandatory law.
13. Indemnification
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable attorneys’ fees) arising out of your use of the Products in violation of these Terms, your violation of any law, or your infringement of any third-party right.
14. Governing law and dispute resolution
These Terms are governed by the laws of Poland (the seller’s place of business), without regard to conflict-of-laws principles. Nothing in this Section deprives a consumer resident in the United States or another jurisdiction of the protection of mandatory consumer protection laws applicable to them.
The parties will attempt in good faith to resolve any dispute by direct discussion before commencing formal proceedings. You may also use online dispute-resolution mechanisms available in your jurisdiction.
15. Changes to these Terms
We may update these Terms from time to time. The version in effect on the day you place an Order governs that Order.
16. Entire agreement, severability, no waiver
These Terms, together with our Privacy Policy, Refund Policy, Shipping / Delivery Policy, and Legal Notice, constitute the entire agreement between you and us regarding the Site and the Products. If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of that right.
